Release of Liability Agreement

FX PARTS AU
Release of Liability & Assumption of Risk Agreement


By purchasing, installing, using, or operating any products supplied by FX PARTS AU, the customer (“Purchaser”, “User”, or “Rider”) acknowledges and agrees to the following terms and conditions:

1. Assumption of Risk

The Purchaser understands that riding, modifying, maintaining, or operating electric bikes, e-bikes, motorcycles, off-road vehicles, and performance vehicles involves inherent risks, including but not limited to:

  • Serious injury or death
  • Mechanical failure
  • Loss of vehicle control
  • Property damage
  • Fire or electrical hazards
  • Accidents caused by improper installation, misuse, or excessive speed

The User voluntarily assumes all risks associated with the use, installation, and operation of any products sold by FX PARTS AU.


2. Motorsport & Off-Road Use

Many products sold by FX PARTS AU are intended for:

  • Off-road use only
  • Closed-course competition
  • Private property use
  • Motorsport applications

It is the Purchaser’s responsibility to ensure compliance with all local laws, road regulations, registration requirements, and safety standards within their state or country.

FX PARTS AU makes no guarantees that any product is street legal in the Purchaser’s location.


3. Professional Installation Recommended

FX PARTS AU strongly recommends that all parts, including but not limited to:

  • Brake kits
  • Controllers
  • Suspension components
  • Wheels & tyres
  • Electrical systems
  • Performance upgrades

be installed by a qualified professional mechanic or technician.

FX PARTS AU is not responsible for damage, injury, or malfunction resulting from improper installation, modifications, neglect, misuse, or unauthorized repairs.


4. No Liability for Damages

To the maximum extent permitted by law, FX PARTS AU, its owners, employees, affiliates, suppliers, and partners shall not be held liable for:

  • Personal injury or death
  • Loss of income or business
  • Vehicle damage
  • Property damage
  • Accidents or crashes
  • Legal penalties or fines
  • Indirect or consequential damages

arising from the purchase, installation, or use of any products supplied by FX PARTS AU.

All products are used entirely at the Purchaser’s own risk.


5. Product Responsibility

The Purchaser acknowledges responsibility for:

  • Inspecting products before use
  • Maintaining their vehicle properly
  • Using appropriate safety gear
  • Ensuring compatibility with their build
  • Riding within safe limits

Failure to properly maintain or inspect components may result in failure, injury, or death.


6. Warranty Disclaimer

Unless otherwise stated in writing, all products are sold “as is” without guarantees or warranties of any kind, express or implied, including fitness for a particular purpose.

Normal wear and tear, misuse, racing, stunting, wheelies, crashes, water damage, or improper installation may void any applicable warranty.


7. Indemnification

The Purchaser agrees to indemnify and hold harmless FX PARTS AU from any claims, liabilities, damages, legal actions, or expenses arising from the use, resale, installation, or operation of products purchased from FX PARTS AU.


8. Agreement

By purchasing from FX PARTS AU, the Purchaser confirms that they:

  • Have read and understood this Release of Liability Agreement
  • Voluntarily accept all risks involved
  • Are legally capable of entering this agreement
  • Agree to release FX PARTS AU from liability to the fullest extent permitted by law
